Acceptable Use Policy
Pahiram works because users trust each other. These rules exist to keep the community safe, fair, and honest.
1. Overview
This Acceptable Use Policy (“AUP”) governs the conduct of all users on the Pahiram.ph platform, including all subdomains (the “Platform”). This AUP is incorporated into and forms part of our Terms of Service.
By using the Platform, you agree to comply with this policy. Violations may result in enforcement actions up to and including permanent account termination and referral to law enforcement.
2. Prohibited Listings
The following items may not be listed on the Platform under any circumstances:
2.1 Illegal Items
- Items that are illegal to own, sell, rent, or possess under Philippine law.
- Stolen property or items obtained through illegal means.
- Items subject to government recalls or safety bans.
2.2 Weapons and Dangerous Items
- Firearms, ammunition, and firearm components.
- Explosives, fireworks, and incendiary devices.
- Bladed weapons prohibited under local ordinances.
- Chemical, biological, or radiological materials.
2.3 Controlled Substances
- Illegal drugs and drug paraphernalia.
- Controlled substances without proper licensing.
- Equipment primarily used for manufacturing illegal substances.
2.4 Counterfeit and Infringing Items
- Counterfeit or replica goods.
- Items that infringe on trademarks, copyrights, or patents.
- Unauthorized copies of software, media, or digital content.
2.5 Restricted and Regulated Items
- Items requiring special licenses that the lender does not hold (e.g., commercial drones without CAAP registration).
- Medical devices requiring prescription or professional operation.
- Gambling equipment where prohibited by local ordinance.
- Surveillance equipment intended for illegal monitoring.
2.6 Hazardous Materials
- Toxic chemicals, pesticides (beyond consumer-grade), and biohazards.
- Radioactive materials.
- Compressed gases without proper safety equipment and documentation.
2.7 Other Prohibited Listings
- Living animals.
- Human remains, body parts, or bodily fluids.
- Items associated with hate groups or promoting violence.
- Listings that are actually services disguised as equipment rental.
- Items the lender does not own or does not have authorization to rent.
3. Prohibited User Behavior
The following conduct is prohibited on the Platform:
3.1 Fraud and Misrepresentation
- Creating accounts with false identity information.
- Submitting forged, altered, or stolen identity documents for KYC verification.
- Misrepresenting the condition, features, or specifications of listed items.
- Filing false damage claims or disputes.
- Manipulating pricing to exploit other users.
- Creating multiple accounts to circumvent enforcement actions.
3.2 Circumventing the Platform
- Arranging payments outside the Platform to avoid service fees.
- Sharing contact information to complete transactions off-platform before a booking is confirmed.
- Using the Platform solely to advertise external services or competing platforms.
- Attempting to bypass security measures, identity verification, or content moderation.
3.3 Harassment and Discrimination
- Threatening, intimidating, bullying, or stalking other users.
- Using hate speech or slurs based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Discriminating against users in rental transactions based on protected characteristics. This includes refusing to rent to users based on race, religion, gender, sexual orientation, or disability.
- Unwanted sexual advances or sexually explicit communication.
3.4 Fake Reviews and Rating Manipulation
- Posting reviews for transactions you did not participate in.
- Offering or accepting payment, discounts, or favors in exchange for reviews.
- Coercing, threatening, or pressuring users to leave, change, or remove reviews.
- Using multiple accounts to inflate ratings or post additional reviews.
- Posting reviews that are unrelated to the actual rental experience.
3.5 Spam and Abuse
- Sending unsolicited commercial messages to other users.
- Posting repetitive, misleading, or irrelevant content.
- Using automated tools (bots, scrapers) to access the Platform without written authorization.
- Uploading malware, viruses, or harmful code.
- Interfering with the Platform’s performance, availability, or security.
3.6 Illegal Activity
- Using the Platform to facilitate any illegal activity under Philippine law.
- Money laundering or financing of terrorism.
- Tax evasion or assisting others in evading taxes.
- Violating export controls or sanctions.
4. Category-Specific Rules
4.1 Drones
- All drones listed must comply with Civil Aviation Authority of the Philippines (CAAP) regulations.
- Lenders must disclose the drone’s registration status and any operational restrictions.
- Renters are responsible for operating drones in compliance with all CAAP regulations, including airspace restrictions, no-fly zones, and licensing requirements.
- Lenders may require proof of drone piloting competency or CAAP certification before confirming a booking.
4.2 Future Categories
As the Platform expands to additional categories (vehicles, cameras, construction equipment, event equipment, etc.), category-specific rules will be published as addenda to this policy.
5. Reporting Violations
5.1 How to Report
If you encounter a listing, message, or user that violates this policy:
- Report Button:Use the “Report” button on any listing, profile, or message.
- Email: Send details to trust@pahiram.ph.
- Support Chat: Contact us through the in-app support chat.
5.2 What to Include
- The listing or user profile URL.
- A description of the violation.
- Screenshots or evidence, if available.
- Your contact information (reports are kept confidential).
5.3 Good Faith Reporting
We encourage reporting in good faith. Filing false or malicious reports is itself a violation of this policy and may result in enforcement action against the reporter.
6. Enforcement Actions
We take violations seriously. Enforcement actions are proportional to the severity, frequency, and intent of the violation.
6.1 Warning
For first-time or minor violations:
- Written notification explaining the violation and required corrective action.
- The offending listing or content may be removed or required to be edited.
6.2 Temporary Restrictions
For repeated or moderate violations:
- Temporary suspension of listing privileges (lenders).
- Temporary suspension of booking privileges (renters).
- Temporary restriction on messaging or review capabilities.
- Duration: 7 to 90 days, depending on severity.
6.3 Account Suspension
For serious or repeated violations:
- Full account suspension for a defined period.
- All active listings removed.
- Pending payouts held pending investigation.
- Duration: 30 days to 1 year.
6.4 Permanent Termination
For severe violations, including but not limited to fraud, submitting forged documents, illegal activity, or persistent violations after prior enforcement:
- Permanent account termination.
- Ban from creating new accounts.
- Forfeiture of any pending payouts related to fraudulent activity.
- Referral to Philippine National Police (PNP) or National Bureau of Investigation (NBI) where applicable.
6.5 Legal Action
Pahiram reserves the right to pursue legal action against users who cause harm to the Platform, its users, or the company. This includes but is not limited to:
- Filing criminal complaints for fraud, theft, or other criminal offenses.
- Civil action for damages.
- Reporting to relevant regulatory agencies (NPC for data violations, CAAP for drone violations, etc.).
7. Appeals
If you believe an enforcement action was taken in error:
- Submit an appeal within 14 days of the enforcement notice by emailing appeals@pahiram.ph.
- Include your account information, the enforcement action reference number, and a clear explanation of why you believe the action was incorrect.
- Our Trust & Safety team will review your appeal and respond within 10 business days.
- Appeal decisions are final.
8. Cooperation with Law Enforcement
We cooperate with law enforcement authorities in accordance with Philippine law. We may disclose user information without notice when required by a valid court order, subpoena, or when we believe in good faith that disclosure is necessary to prevent imminent harm, fraud, or illegal activity.
9. Changes to This Policy
We may update this Acceptable Use Policy from time to time. Material changes will be communicated at least 14 days before taking effect through email and/or Platform notification. Your continued use of the Platform after changes take effect constitutes acceptance.
